By downloading, installing, or using the Kaky mobile application ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the app.
These Terms form a binding agreement between you and Mira Acaya, the developer of Kaky ("we", "us"). You must be at least 13 years old to use the app.
Kaky is a voice-first nutrition tracking app. It allows you to:
The app is provided free of charge. We reserve the right to introduce paid features in future versions; you will be notified before any payment is required.
Kaky uses a third-party AI service (OpenRouter routing requests to Google's Gemini AI model) to identify foods from your descriptions and estimate their nutritional content. By using these features you acknowledge:
Tip: When portion size matters, use the in-app portion controls (½×, 1×, 2×) to refine the estimate. The more specific your description, the more accurate the result.
Important: Kaky is a tracking tool, not a medical device. The information it provides is for general informational purposes only and is not intended as a substitute for professional medical, dietary, or nutritional advice, diagnosis, or treatment.
Always consult a qualified healthcare provider before making decisions about your diet, especially if you have a medical condition (such as diabetes, eating disorders, kidney disease, or pregnancy) or are taking medication.
Do not rely solely on Kaky to manage a medical condition. We are not liable for any health outcome resulting from use of the app.
You may use Kaky without an account, but signing in unlocks cloud sync. When you sign in (via Apple or Google), you agree that the information you provide is accurate. You are responsible for keeping your sign-in credentials secure.
You may delete your account and all associated data at any time from Settings → "Delete account." Deletion is immediate and irreversible.
When using Kaky, you agree not to:
We reserve the right to suspend or terminate accounts that violate these rules.
Kaky, including its design, code, logo, and content, is owned by Mira Acaya and is protected by copyright and trademark laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.
Your meal log data belongs to you. By using the app, you grant us a limited license to store and process this data only to provide the service to you (sync, analysis, display).
Kaky relies on third-party services to function, including:
Each of these providers has its own terms of service. Your use of Kaky is also subject to those terms when applicable. See our Privacy Policy for links.
You may stop using Kaky at any time by uninstalling the app and deleting your account. We may terminate or suspend your access to the service at our discretion, with or without notice, if you violate these Terms or for any other lawful reason.
Sections that by their nature should survive termination (Ownership, Disclaimers, Limitation of Liability, Governing Law) will continue to apply after termination.
Kaky is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, secure, or that nutrition estimates will meet any particular standard of accuracy.
To the maximum extent permitted by law, in no event shall Mira Acaya be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, health outcomes, or goodwill — arising from your use of the app, even if advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to these Terms or the app shall not exceed the greater of (a) the amount you have paid us in the past twelve months, or (b) USD $50.
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by updating the "Last updated" date at the top of this page. Continued use of the app after changes take effect constitutes acceptance of the new Terms.
These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to its conflict of laws principles. You agree that any dispute arising from these Terms or your use of the app will be resolved in the courts of that jurisdiction, except where prohibited by applicable consumer protection laws.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
