These Terms of Service (“Terms”) are an agreement between you and Mira Acaya, the developer of Kaky (“Kaky,” “we,” or “us”). By downloading, accessing, purchasing through, or using Kaky, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old to use Kaky. If local law requires a higher minimum age or parental authorization, that requirement applies.

Kaky is distributed through Apple’s App Store and is licensed—not sold—to you. Apple’s Standard Licensed Application End User License Agreement governs your license to the application unless a valid custom EULA is provided in App Store Connect.

Kaky is a voice-first nutrition tracker that can help you:

• Describe meals by voice or manual text.
• Receive estimated foods, servings, calories, macronutrients, and other nutrition information.
• Save meals and compare daily totals with personalized targets.
• Track water, weight check-ins, streaks, and progress patterns.
• Sync supported information across devices when signed in.

Features may change as Kaky improves. We may add, remove, limit, or redesign functionality, provided that we comply with obligations that apply to active paid subscriptions.

Kaky uses third-party AI processing services to transcribe voice recordings, identify foods from natural-language descriptions, and estimate nutrition. The output may be incomplete, inaccurate, or based on typical portions rather than the exact product or preparation you consumed.

• Review food names, servings, calories, and nutrients before saving.
• Correct results when the interpretation does not match your meal.
• Be specific about brand, preparation, portion, and any calorie amount you already know.
• Do not rely on an estimate as an exact laboratory measurement.

When you state an explicit calorie total, Kaky is designed to preserve it as your supplied value. You remain responsible for deciding what information to log and for verifying information that matters to your health.

Kaky is a general wellness and tracking tool—not a medical device, healthcare provider, dietitian, or substitute for professional advice, diagnosis, or treatment.

Do not disregard professional advice or delay seeking care because of information shown by Kaky.

You may use supported Kaky features as a guest. Guest information is primarily stored on the device and may be lost when Kaky is deleted, the device is erased, or local data is otherwise removed.

Signing in can protect supported data with cloud sync and associate Kaky Pro access with the correct Kaky identity. You agree to provide accurate information, protect access to your Apple or Google sign-in account, and notify us if you suspect unauthorized access.

You may request account deletion through Settings. Deleting a Kaky account does not automatically cancel a subscription billed by Apple.

Kaky Pro is an auto-renewable subscription purchased through your Apple App Store account. Available plans, billing periods, localized prices, included features, and any introductory trial are shown on Kaky’s purchase screen and Apple’s confirmation sheet before you authorize payment.

• If Apple confirms that you are eligible for a free trial, you are not charged during the stated trial period. Unless canceled before the trial ends under Apple’s rules, it converts to the selected paid subscription.
• Paid subscriptions automatically renew unless canceled before the end of the current billing period. Apple charges your App Store account.
• Manage or cancel through your Apple account’s subscription settings. Removing Kaky or deleting your Kaky account does not cancel billing.
• Introductory-offer eligibility is determined by Apple and is generally limited to one offer per subscription group.
• Refund requests and App Store billing disputes are handled by Apple under Apple’s policies.

Use “Restore purchase” in Kaky to restore eligible access. Subscription access may be associated with a Kaky account and App Store receipt to prevent duplicate use, fraud, and unauthorized transfers. Cancellation stops future renewal; access ordinarily continues until the expiration Apple reports.

You agree not to:

• Use Kaky for an illegal purpose or in violation of applicable law.
• Attempt to gain unauthorized access to Kaky, other accounts, or service infrastructure.
• Bypass subscription verification, free-use limits, security measures, or usage controls.
• Probe, scrape, overload, automate against, or interfere with Kaky’s APIs without permission.
• Submit malicious content or use Kaky to harm, harass, deceive, or infringe the rights of others.
• Resell, sublicense, or commercially exploit Kaky or its outputs without written permission.

We may limit or suspend access reasonably necessary to investigate abuse, protect users, secure the service, or enforce these Terms.

Kaky’s design, software, branding, content, and related intellectual property are owned by Mira Acaya or their respective licensors and are protected by applicable laws.

Your meal descriptions and tracking information remain yours. You grant Kaky a limited permission to host, process, transmit, and display that information only as reasonably necessary to provide, secure, and improve the service you request, consistent with the Privacy Policy.

Feedback and product suggestions may be used to improve Kaky without an obligation to compensate you.

Kaky relies on providers including Supabase for authentication and cloud infrastructure, OpenRouter and selected AI providers for transcription and nutrition analysis, RevenueCat for entitlement management, and Apple and Google for distribution, billing, permissions, or sign-in.

Availability, processing, and transactions may be affected by those providers and are also subject to their applicable terms. Details about data handling are provided in our Privacy Policy.

You may stop using Kaky at any time and may request deletion of your account. Apple subscriptions must be canceled separately through Apple.

We may suspend or terminate access when reasonably necessary to enforce these Terms, comply with law, protect Kaky or other people, or address security and abuse. Provisions that by their nature should survive—including ownership, disclaimers, limitations, and dispute terms—remain effective after termination.

To the fullest extent permitted by law, Kaky and its services are provided “as is” and “as available,” without warranties of uninterrupted availability, error-free operation, nutrition accuracy, fitness for a particular purpose, merchantability, or non-infringement.

To the fullest extent permitted by law, Mira Acaya will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages—including lost data, profits, goodwill, or health outcomes—arising from Kaky or your inability to use it.

Where liability cannot be excluded, total liability for claims relating to Kaky will not exceed the greater of the amount you paid for Kaky during the preceding twelve months or USD $50. Some jurisdictions do not allow certain exclusions, so these limitations apply only to the extent permitted.

We may update these Terms as Kaky changes. We will update the effective date and provide additional notice when a change is material. Your continued use after the effective date constitutes acceptance of the updated Terms, except where law requires another form of consent.

These Terms are governed by the laws applicable in Mississippi, United States, without regard to conflict-of-law principles, except where your local consumer law requires otherwise. If a provision is unenforceable, the remaining provisions remain in effect.
